And
that’s the divide! Divide governed by different political goals and aspirations.
And this divide is shaped and consolidated by the history of Islamic regime in
Kashmir beginning mid 14th century CE and continuing to be in 21st
century CE. Nothing materially has changed on the ground because even though NC
is in power, the politics of the region is dictated by Islam's ideologues and
Islamic region of Kashmir is here to stay. Whatever be the claims of Modi-Shah
duo on “normalcy” in Kashmir, the fact of it is that Kashmiri Muslims led by
their religious and political leadership continue to be not only anti-India,
but also anti-Hindu.
The
achievements of erstwhile J&K State:
For
some, politics is only about sloganeering and keeping the society on the boil
for reasons that are an antithesis to the well being and progress of the
constituencies these kinds of politicians claim to represent. Kashmiri Muslim politicians
fall in this category.
The
erstwhile statehood ended up with, dehumanising Kashmiri Pandit society in
particular and J&K people as a whole; institutionalising prostitution in
the valley; devouring young and old lives in thousands; forcing into exile a
whole lot of ethno-religious minority from the valley after committing genocide
on it and thus homogenizing an hitherto heterogeneous Kashmiri society;
poisoning the inter relationships among different religious groups; alienating
people of Jammu and Ladakh under the regimes of the parties like NC, PDP and
Congress because of crass discrimination against the Jammu & Ladakh regions
with regards to funds allocation in the erstwhile state; corrupting successive
generations of Muslims with concocted history like India had illegally occupied
Kashmir and thereby not allowing it to become integral part of Pakistan;
etcetera.
Simultaneously,
the ruling dynasties and their friends in other parties made astronomical
fortunes for their generations next to enjoy; the self proclaimed leaders of
the ‘Azadi’ movement were not to be left behind in devouring currency from both
sides of the divide and building properties with their families enjoying cosy
and comfortable lives at the cost of a whole lot of Kashmiri Muslims whom they
had pushed in to the fires of Hell (the ruthless power of the Indian State) by instigating
them to wage the war against “infidel” India.
The
Jurisdiction of a UT government:
The
union territory is administered under the provisions of Article 239 of the
Indian Constitution.
The
President of India appoints a Lieutenant Governor (LG) for the union territory.
A Council of Ministers led by a Chief Minister is appointed by the LG from the
membership of the legislative assembly. Their role is to advise the LG in the
exercise of functions in matters under the jurisdiction of the legislative
assembly. In other matters, the LG is empowered to act in his own capacity. The
legislative assembly may make laws for any of the matters in the State List of
the Constitution of India except “public order” and “police”, which remain the
preserve of the Central Government of India. The LG also has the power to
promulgate ordinances which have the same force as the acts of the legislative
assembly. So, only “public order” and “police” fall outside the purview of the
local government and that the LG has powers to promulgate ordinances. And
therein lies the catch!
UT
Status is the Impediment in advancement of Nefarious Political Designs in
J&K:
Because
maintenance of ‘law and order’/public order is outside the purview of the UT
Legislative Assembly. Getting the
J&K UT restored to the status of a State is the first goal to be achieved because
then and only then the Kashmiri Muslim political and religious leaders of all hues
in synchronism with their masters in Pakistan would be able to implement their
designs for one more bout of insurgency (Hum Kya Chahtae Azadi) against
“infidel” India. Lacs of the local Kashmiri Muslims shall come down to streets,
raise anti-India slogans using loudspeakers of mosques And the police/armed constabulary
shall remain in their barracks to be mute witnesses. Like what the KP Community
witnessed to its horror beginning 1986.
The
Kashmiri Muslims (males and females) have already given a hint of their
preparedness for their ‘sacred mission’ by beating their chests/breasts for Nasrallah,
Ayatollah Khamenei and the residents of “Azad Kashmir”. And they are promised
of the support from Muslim political and religious leaders in other parts of
India.
Will
the Modi-Shah duo concede Statehood to J&K?
Yes,
at India’s own peril. If indeed those in the service of “pasmandas” and
propagandists of “common DNA” grant statehood to J&K, it shall be recorded
in history as the Classic case of the political leadership of a Nation
facilitating its balkanization. But for a sane leadership and political
dispensation, for sure, public order and police cannot be trusted with the
local satraps because of the experiences since 1986. NC can have no claim to
any kind of governance in the erstwhile J&K state because it was the party
to institutionalising a compromised state machinery and its elected Chief
Minister fled to London for playing golf when the state had been seized by the
self proclaimed freedom fighters supported covertly by all the “mainstream”
parties and by the then Home Minister of India who was responsible for Anantnag
riots and at the instance of Sri Vajpayee years later founded PDP which turned
out to be a big boost for Islamic Mujahideen.
That
the LG is empowered to issue ordinances is to safeguard the people of the UT
from some adventurism of seasoned rogue politicians because the Government of India and its political
leadership cannot allow any such activities within Kashmir and Muslim majority
regions in Jammu province which question the geographical integrity of Indian Nation.
Because another bout of adventurism cannot be allowed, therefore, statehood
cannot/shouldn’t be granted to J&K UT.
The
Demand of Kashmiri Pandits for Homeland UT:
Any
civilized Nation that truly believes in protecting its diversity in domains
like, socio-religious, socio-cultural, belief systems, religious rituals and
practices including diversity in the languages spoken within its geographical
map is bound to concede to Kashmiri Pandit (KP) Community its demand for a
separate Homeland with a UT status carved out of Kashmir. Because history of
Islamic barbarism as unleashed on the KP Community beginning mid 14th
century CE and extending to 21st century CE is not debatable.
Even
if one was to go by the thesis written by apologist of Islam (like Communists,
“Islamic Scholars” and self serving “Hindu” politicians) eulogizing the Islamic
regimes in Kashmir and other parts of India until the advent of Sikh rule in
Kashmir and British rule in India, the barbarism unleashed by Kashmiri Muslim
leadership on KP Community beginning 1931 and extending up to 21st
century CE is beyond debate as it culminated into cleansing the Valley of her
aboriginals, the KP Community, in “democratic and secular” Indian dispensation.
Arguments
in Favour of Homeland:
Why
should Kashmiri Pandits trust Kashmiri Muslims?
For
all acts of dehumanizing faced by the Pandits at the hands of Muslims since
1339 and essentially the 1991 exodus thrust upon them, it is difficult nay
impossible to conceive that the Pandits and their future generations would be
safe in the hands of Muslims, if they decide to return back to the places in
the Valley from where they were forced to flee. The problem with such an
resettlement is religio-political; not social, cultural and economical. It’s
the threat of Islam’s ideology that disables it because of Islam’s intolerance towards temples, idols and
polytheists and its anti-Nature character.
What
is a Stateless Nation?
A
nation that does not comprise the majority of the population in the country
where its homeland is located, or in any other country.
Since
When is KP Community a Stateless Nation?
Since
the advent of Islamic rule in Kashmir. Yet, some inconsequential numbers
remained who continued to live in their land of heritage and culture, despite
facing all kinds of discriminations in their day-to-day life. Then arrived 20th
century “modern” Indian State and one time near full excavation of the
aboriginals was ruthlessly implemented in “democratic” and “secular” India. The
aboriginals became refugees in India creating a diaspora within and without its
geo-political boundaries.
Right
to Live/Life:
No
Man-made Constitution on Earth is qualified to grant right to live/life to any
being because it was granted by the Creator the day one was born. The Indian Constitution
is only required to ensure it through various State agencies. And it has failed
to do so in the case of KP Community.
What
does Right to Live/Life Encompass?
It’s
not just about breathing in and breathing out. It’s about living a whole life
without apprehensions of an impending disaster/annihilation; it’s about being
able to draw inspiration from a Nation’s heritage, follow religious practices
and culture including belief systems, choose a vocation of one’s choice-
without any fear of or ridicule from aliens. Whatever be the claims of having
restored “normalcy” in Kashmir, the message has been sent loud and clear to KP
Community that it is not welcome in there. Therefore, fundamentally the KP
Community is deprived of Right to Life.
Why
Homeland?
To
enable the KP Community to live in the way as described in the preceding
paragraph. The Homeland to the North and East of river Vitasta just about
creates an environment that would facilitate the Right to Live in all its
dimensions. A Nation with a State- Nation State not sovereign though. It frees
the KP Community from the fear of yet another calamity befalling it in near or
distant future; insures future of its never ending generation next. It
politically empowers the community to enable it to take steps for economic empowerment, maintain heritage sites/monuments and places
of worship as also enrich its language. And to ensure its creation is the
fundamental responsibility of a civilized Nation State that India claims to be.
Political
Resolution the Only Way:
The
Central government led by BJP/RSS should put its mind on creating a Homeland
for the Pandits the same way as Chhattisgarh, Jharkhand, Punjab, Uttarakhand, Haryana,
Himanchal and Telangana were created. The Indian Constitution allows bifurcation/reorganization
of States.
The
bottom Line:
If
Muslims demand to partition Indian subcontinent could be conceded because they
declared that they couldn’t Live under a Hindu majority state ruled by Hindus,
there is No reason why Kashmir cannot be partitioned for carving out a Homeland
UT for KP Community because Kashmiri Muslims committed genocide on it and
forced it into exile. No rational mind can vouch for Pandit-Muslim coexistence
in the Valley.
