Import of Yasin Malik Conviction: Pandits & IAF are dispensable

The VIP terrorist who at his will had rendezvous with PMs of India including Manmohan Singh and A B Vajpayee and who was made into a cherished guest by Media channels was handed down life imprisonment by a Delhi Court. Sure, he will have a right to appeal while in jail. He may have to go to jail because punishment is for more than 3 years. The judiciary at higher and highest level may end up reducing his punishment.

Conviction: Justice or Mockery of it?

The immediate inference that can be drawn from the court decree is that he was an innocent being till 2017 when suddenly he funded terror activities & was duly implicated. Can there be a bigger farce than this? Any less than an idiot person’s response will be “No”.

Why his crimes against Pandits and IAF were ignored?

Few reasons can be underlined as below:

1.       The biggest handicap of NDA government was that Sri Vajpayee & his government had entertained him and thereby accorded respectability to him. If it was only Manmohan Singh and others, the BJP would have blown the trumpet from their roof tops accusing the governments of according him the status of a political activist. The Hurriyat had accused Modiji of deviating from the Vajpayee path.

Like, when the US held negotiations with the Taliban in Doha regarding their forces exit from Afghanistan, the Taliban ceased to be terrorists because a State can’t negotiate with terrorists. Similarly, when Yasin Malik was engaged by Indian political leadership and Media, he transformed from being a terrorist to a political activist. Could Modi government censure Vajpayee government by implicating Yasin Malik of his crimes against Pandits? No.

2.       There could be a deal with Yasin Malik in that his life could be spared if he vomited certain secrets about Pak designs in J&K and what used to be the content of dialogue between the Hurriyat and Pakistan, that went on for decades since 1971. The most important could be the information about the covert role played by the “mainstream” in instigating public opinion against the Indian State and their contacts with the neighbouring Islamic Republic. If Yasin Malik has, indeed, spilled the beans, then Abdullahs & Muftis et al may be in for a trouble.

3.       Yasin Malik’s political aim was to achieve an independent and sovereign Nation State of J&K; even though his visible support base was in his locality of residence (Mysooma Bazar) the silent support from other parts of the Valley was not deniable. So, if the Modi government had a feel of his mass base, then hanging him would create more problems than solve any. Hence scaling down the punishment and that was achievable only if his crimes against Pandits and IAF personnel were ignored.

BJP can’t deny being progenitor of PDP:

The Loh Purush Incarnate 1, the HM in Sri Vajpayee’s government was very keen on having a connect with the Valley terrorists, in order to negotiate with them for peace in the region. A terrorist turned mainstream in an interview to a newspaper disclosed that Sri Advani had asked him if Mufti Sayeed had any connect with the terrorists and he had answered in the affirmative thinking that his reply would politically benefit him, but had later realized his foolishness in spilling the beans when Mufti was asked by Vajpayee to form his own political party and not waste his time in Congress. Congress who had refused to declare him a CM candidate and Mehbooba as President of J& K Congress immediately accepted the proposal and formed PDP. Mufti who was known for his treachery didn’t oblige Advani by disclosing either the names of terrorists he had connections with or their organizations. The baby had grown too big for its parent and it was undoubtedly clear when he thanked Pakistan and Hurriyat including “militants” for allowing peaceful elections in the J&K State! Like always a Kashmiri politician outsmarted the National political leadership.

Why so desperate to strike deal with terrorists?

On Hurriyat’s stand that “Pakistan’s narrative on Kashmir can’t be ignored”, the Indian Political Leadership from all National parties didn’t have the conviction to tell Hurriyat that Pakistan was not a stakeholder for reasons historical and therefore Hurriyat’s agenda was unrealistic in that it defied history. Why? Either the leadership hadn’t read history of the region’s Accession to India & subsequent defaulting of Pakistan on UN Resolutions or they were too conscious of the Muslim votes in rest of India and didn’t want to be too stern with “separatists” and “mainstream” in bringing them and other terrorist organizations to justice under Indian Law. Indian Law because Art 370 had ceased to exist after the Chair of PM in J&K was relegated to that of CM in 1966 & its stinking skeleton was buried in 1974 (Indira Sheikh Accord), no matter how deafening the high pitch of BJP may become in claiming abrogation of the article.

The Current Situation in Valley No Strength Booster:

Modi government J&K policy doesn’t seem to succeed because the killings of innocents have not only increased, but have become secular too in that not only Pandits are being targeted, the local Muslims too are; not to forget non-Kashmiris who too have come onto the radar of terrorists.

The ghost of demographic change as floated by the “mainstream” and the claim of the abrogation of non existent  370 have succeeded in created a fear among the local Muslims that they are systematically being deprived of their rights by the present Indian government. Turmoil is within and yet to explode; not many local Muslims have condemned killings of Pandits and non locals as they are indoctrinated to believe that the two are predators out to grab their resources and opportunities.

Therefore, ruthlessness of State need to take back seat; police and paramilitary forces including army may liquidate terrorists, but cannot eradicate the apprehension, indoctrinated by the “mainstream” and their ilk, that they are being robbed of their freedom to live as per their dictates.

The Sacrificial Goats:

The State must defend its boundaries, if not expand them; therefore, the interests of a State (earlier Samrajya) take precedence over those of its subjects; and in that endeavour Pandit community and military personnel are surely dispensable; after all who can beat the argument “military personnel as police and paramilitary ones are their to lay life for defending the integrity of a Nation State”. Insofar as Pandits are concerned whole of India is for them!!

A poet put down following lines decades ago:

“Cheen aur Arab hamara Hindustan hamara, rehnae ko ghar nahin hai saara jahaan hamara”- most relevant for us – the Pandits of Kashmir.
