While Implementing Uniform Civil Code Beware of Jinnah Politicians.

The Uniform Civil Code (UCC) calls for the formulation of one law for India, which would be applicable to all religious communities in matters such as marriage, divorce, inheritance, adoption and maintenance. The code comes under Article 44 of the Constitution, which lays down that the state shall endeavour to secure a UCC for the citizens throughout the territory of India.

It continues to remain disputed by India's political left wing, Muslim groups and other conservative religious groups and sects in defence of Sharia and religious customs. Personal laws are distinguished from public law and covers matters as mentioned in the preceding paragraph.

Objective of Art 44:

The objective of Article 44 of the Directive Principles in the Indian Constitution was to address the discrimination against vulnerable groups and harmonise diverse cultural groups across the country. Dr. B R Ambedkar, while formulating the Constitution had said that a UCC is desirable but for the moment it should remain voluntary, and thus the Article 35 of the draft Constitution was added as a part of the Directive Principles of the State Policy in part IV of the Constitution of India as Article 44. It was incorporated in the Constitution as an aspect that would be fulfilled when the nation would be ready to accept it and the social acceptance to the UCC could be made.

India's political left wing & Muslim groups:

The political ideology of Communists and Muslims is one and the same when it comes to establishing oppressive regimes that are intolerant to any kind of human freedom; the former are intolerant towards all religions and excel in persecuting people of all religious faiths and the latter is totally intolerant to faiths other than Islam.

Both don’t believe in a democratic dispensation, but the difference is that while Muslims support consensus-based governance, the Communists excel in implementing a totalitarian set-up. Despite their disbelief in a democratic set-up, they chose to become a part of democratic set-up for their own nefarious political designs. And that was and continues to be “wreck the system from within”. This obnoxious political design has to be borne in mind, if their opposition to implementation of UCC is to be understood.

Directive Principles of Constitution:

These are not justiciable and that means that courts including the SC cannot adjudicate upon any law that is dictated to be enacted under these principles. Therefore, enacting UCC is not challengeable in courts. One big relief!

Article 35 was added to the Constitution as a temporary provision because Dr. B R Ambedkar may have thought of providing for some settling time for a nascent nation which excelled in diversity of cultures and religions. The Q is: Will the Muslim political and religious leadership allow UCC after 75 years of independence? The answer is: No. The Why part of it is explained in the lines to follow. The Left and liberals have no impressionable mass base left to influence the gullible in arousing their basest instinct to create turmoil in the Indian society and so they are tagging along with Muslim political and religious leadership. And this is their political chicanery that they support a religious group while being total disbelievers. But then they too have nefarious political designs that can be best accomplished by forging an alliance with Muslim leadership.

Swearing by Sharia:

The likes of Asaddudin Owaisi and Shahi Imam of Jama Masjid and their ilk can’t be protagonists of Sharia knowing their lifestyles. It’s not that they don’t know that living by Sharia would make Muslims into an island inaccessible to the world around, but their political aim of balkanizing India once again compels them to arouse passions of common Muslims and keep the discord between them and others alive and strive hard to deepen it. It’s the same methodology that Jinnah adopted which ultimately gave birth to Pakistan. The  venomous speeches of Muslim leadership also indicate in that direction.

If one looks at Islamic Emirate of Afghanistan and Islamic Republic of Iran, the implementation of Sharia Rule is confined to oppressing women and girls and keeping them locked within the four walls of their houses; in all other spheres of human endeavour these Islamic Nations follow “Kafir” Rule and their science and technology and not to forget the Western delicacies. All that’s prohibited in Islam under Sharia Law is followed unabashedly including consuming liquor and womanizing; while Taliban leadership have confined women to within four walls of their house, their own daughters are studying in Dubai! Like our own Mehbooba Mufti who advocates “Pure Sharia”, but every moment of the day violates it in her family.

In Islamic State of Pakistan, the “terrorist” organizations were nurtured in multiple numbers to establish Sharia Rule in “Kafir” India, but all their efforts have culminated into multiple self goals, what with TTP on its mission to establish Sharia Rule in Pakistan! But Islamic State of Pakistan is opposing it! The only object Pakistan has achieved is annihilation of minorities and forced conversions of their girls into Islam and marry them only to make them sex slaves. This Islamic State is a total failure as is Afghanistan since both are perennially dependent on aid from “Kafir” Nations across the Globe.

The protagonists of Sharia in India:

They need to take a call on Muslim artists, musicians, lyrists, actors and actresses et al and decide to expel them from the Muslim community and simultaneously direct banks not to pay any interest on their deposits including S/B account; further withdraw their girls from schools and colleges; shun modern medical cure & follow as prescribed by Prophet Muhammad; eat only such food as prescribed by “Law of Allah”, and disengage themselves from electoral politics, etc. Engage in Jihad against “Kafirs” only to be annihilated by Indian State. But they will not do it because aim is not to follow Sharia Law, but to deepen the religious based divisions in Indian society.

Who will benefit from UCC?

It deals with issues like marriage, divorce, inheritance, adoption and maintenance.  Now, anybody – irrespective of his/her Faith - with a little bit of awareness of the society’s dynamics shall say that the implementation of UCC is going to help women’s cause; women who have always been discriminated against across religions and regimes. Precisely it’s this that Muslim clergy and the likes of Owaisi shall not allow because it’s their fiefdom where they oppress the underprivileged amongst their community and generate revenue from the well to do ones, more than willing to look the other way if an aristocratic Muslim lady is dressed up in Western style. And the revenue they generate is used to fuel anti Hindu and anti India hatred – the way Jinnah did.

Munafaqat is Islamic if aim is Balkanizing India:

The double standards of Muslim clergy and political leadership is quite evident from their private lives and public stances. Munafaqat which is intolerable in Islam is practiced to supposedly further Islamic cause.

There is this highly revered Clergy in Pakistan who preaches 24x7 how women should cover themselves with Burqa with only small slits for eyes to see and he owns a state of art Mall in Lahore which sells branded Western dresses for women! Remember that no woman from a minority community has financial strength to buy dresses from this mall.

The bigger game is that even the Muslim intellectuals lack the gumption to take on these Munafiqs publicly. Who knows it better than Ms Shabana Azmi who, for all her self proclaimed revolutionary instincts did not think it proper to retaliate when the then Shahi Imam of Jama Masjid called her “Tawaif” on live NDTV show. For all their intellectualism, they fall in line at the command of a clergy.

Enactment of Law:

Because BJP  in the Parliament has majority in both the houses, it shall be an easy passage, allowing for ruckus in both the houses; but the government led by BJP leadership should have plans in place to counter Jinnahs and their plans, post enactment of UCC as a law.
